Terms of Service

These Terms of Service ("Terms") govern access to and use of beadrift.com, the Beadrift Studio, Inspiration, customer accounts, and purchases from Beadrift (collectively, the "Services"). In these Terms, "Beadrift," "we," "us," and "our" refer to Beadrift. "You" means the person accessing or using the Services.

By accessing the Services, creating an account, publishing content, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be able to enter into a binding contract where you live to place an order or publish content. If you are under the age of majority, a parent or legal guardian must supervise and authorize your use.

You are responsible for the accuracy of information submitted through your account and for activity performed through it. Keep access credentials secure and notify us if you believe an account has been used without permission. Shopify manages customer authentication and may apply its own terms to account services.

Beadrift products include small parts. They are not suitable for children under 3. Products intended for children age 6 or older should be selected and used with appropriate adult supervision. Jewelry is not a toy.

2. The online store and acceptable use

You may use the Services only for lawful personal or commercial shopping, design, and community purposes consistent with these Terms. You may not interfere with the Services, bypass security or access controls, scrape or extract data at unreasonable scale, introduce malicious code, impersonate another person, misuse another person's information, infringe intellectual-property rights, submit unlawful or deceptive content, or use the Services to harass or harm others.

We may limit, suspend, or terminate access when reasonably necessary to protect customers, Beadrift, service providers, or the integrity of the Services.

3. Product information and natural materials

We try to present products, materials, colors, measurements, availability, and prices accurately. Screen settings, photography, lighting, and the characteristics of natural and handmade materials may affect appearance. Natural stone, freshwater pearl, glass, plated findings, and handmade assemblies can vary in color, pattern, shape, surface, translucency, and placement. These reasonable variations are part of the product and are not necessarily defects.

Material names and labels describe the information reasonably available to us. Plated and painted finishes may change with wear, moisture, chemicals, fragrance, lotion, exercise, or storage. Review product descriptions and the Care guide before purchase, and contact us before ordering if you have a known material sensitivity.

Products, color guides, Five Elements content, and other editorial material are offered for design and informational purposes. They are not medical, diagnostic, therapeutic, predictive, or professional advice.

4. Studio previews, fit, and custom designs

Studio provides a visual approximation of a bracelet based on selected materials, sequence, wrist size, and fit. The preview is not an exact photographic or physical guarantee. Written measurements, selected components, quantities, and fit recorded with the order are the production reference.

You are responsible for reviewing wrist size, fit, design, itemization, price, and shipping information before checkout. A bracelet made to those selections is a custom, made-to-order item. Changes may not be possible after the 15-minute cancellation window, and return restrictions are explained in the Refund Policy.

Component availability is checked during the shopping and checkout process but can change. If a selected component becomes unavailable after purchase, we will contact you before making a material substitution.

5. Orders, prices, and payment

Submitting an order is an offer to purchase. We may accept, reject, or cancel an order for legitimate reasons including inventory error, pricing error, suspected fraud, payment failure, shipping restriction, or inability to produce the confirmed design. If we cancel a paid order, we will refund the cancelled amount.

Prices are shown in USD unless stated otherwise and may change before an order is submitted. The price charged is the amount confirmed at checkout, subject to correction of an obvious error. Taxes, shipping charges, discounts, and any applicable fees are shown at checkout when available.

Checkout and payment processing are provided by Shopify and payment providers. Beadrift does not directly receive full payment-card numbers. You represent that you are authorized to use the payment method submitted with an order.

Promotions, discount codes, and free-shipping offers may have separate conditions, expiration dates, geographic limits, minimum values, exclusions, or usage limits. Unless stated otherwise, promotions cannot be combined or applied retroactively.

6. Shipping, cancellations, and refunds

Shipping estimates, tracking, address responsibilities, and delivery issues are governed by the Shipping Policy. Cancellation eligibility, final-sale restrictions, product issues, and refunds are governed by the Refund Policy. Those policies form part of these Terms.

Risk of loss and legal title pass as required by applicable law. Nothing in these Terms removes a mandatory right relating to nondelivery, damage, or defective goods.

7. Inspiration, sharing, and user content

Inspiration allows eligible signed-in users to publish bracelet images, design names, stories, mood labels, maker names, recipes, and related information ("User Content"). Publishing is optional. Content you publish is public and may be viewed, shared, indexed, and remixed by others.

You retain any ownership rights you have in your User Content. By publishing it, you grant Beadrift a worldwide, non-exclusive, royalty-free license to host, store, reproduce, crop, format, adapt for display, publish, distribute, and promote that content for operating, improving, and communicating about Beadrift and Inspiration. This license allows technical resizing, storefront display, social previews, moderation, backups, and Beadrift marketing that credits the maker where reasonably practical. It does not transfer ownership of your original content to Beadrift.

By publishing a design recipe or arrangement to Inspiration, you understand that other users may open, copy, adapt, purchase, or publicly share similar designs through Remix or Studio. Publication does not give you an exclusive right to a combination of generally available components.

You represent that you created or have permission to use the User Content you submit and that it does not violate another person's rights, privacy, or law. Do not publish confidential information or images of another person without permission. We may decline, hide, remove, or moderate content that violates these Terms, creates legal or safety risk, or is unsuitable for the community.

You may request removal of your published User Content by contacting support. Removal from active display may not immediately remove cached copies, prior lawful shares, transaction records, or backups retained for security and legal purposes.

8. Beadrift intellectual property

The Services, including Beadrift branding, site design, software, text, graphics, photography, illustrations, interfaces, and Beadrift-created content, are owned by or licensed to Beadrift and are protected by applicable intellectual-property laws. Except as expressly allowed through sharing and Remix features, you may not copy, sell, license, reverse engineer, republish, or commercially exploit these materials without written permission.

9. Feedback

If you voluntarily send ideas or feedback about the Services, you allow us to use that feedback without restriction or compensation, provided we do not publicly identify you without permission.

10. Third-party services and links

The Services rely on third parties including Shopify, payment processors, authentication providers, hosting providers, fulfillment partners, and carriers. Third-party sites or services may have their own terms and privacy practices. We are not responsible for independent third-party content or conduct, but this does not limit responsibility that cannot legally be excluded.

11. Privacy

Our Privacy Policy explains how personal information is collected, used, and shared. By using the Services, you acknowledge the processing described in that policy. Shopify also processes information under its own applicable privacy notices.

12. Service availability and changes

We may update, correct, suspend, or discontinue parts of the Services, product assortments, features, or content. We do not guarantee that the Services will always be uninterrupted, secure, or error-free. We will not make a change to an accepted order without an appropriate customer resolution.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided on an "as available" basis. We disclaim implied warranties that may lawfully be excluded. We do not exclude any express product promise, mandatory consumer warranty, or right that cannot be waived under applicable law.

14. Limitation of liability

To the maximum extent permitted by law, Beadrift and its service providers will not be liable for indirect, incidental, special, exemplary, or consequential loss arising from use of the Services. Where liability may lawfully be limited, Beadrift's aggregate liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence, breach of a non-waivable consumer right, or any liability that applicable law does not allow us to exclude or limit.

15. Indemnity

To the extent permitted by law, you agree to be responsible for claims and reasonable costs caused by your unlawful misuse of the Services, your violation of these Terms, or User Content that infringes another person's rights. This section does not require a consumer to compensate Beadrift for Beadrift's own negligence or unlawful conduct.

16. Governing terms and disputes

These Terms and any separate agreement with Beadrift are governed by the laws applicable at Beadrift's principal place of business, without regard to conflict-of-law rules. This choice does not deprive you of mandatory consumer protections that apply where you live.

Before starting formal proceedings, please contact support@beadrift.com so we can try to resolve the issue. Nothing in these Terms prevents either party from using an available small-claims process, seeking urgent relief, or exercising a non-waivable statutory right.

17. Severability, waiver, and assignment

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent; Beadrift may transfer them as part of a legitimate reorganization, financing, merger, or sale, subject to applicable law.

18. Changes to these Terms

We may update these Terms from time to time. The current version and last-updated date will appear on this page. Changes apply prospectively when posted unless applicable law requires additional notice. The Terms in effect when an order is accepted continue to govern that order.

19. Entire agreement

These Terms, the Privacy Policy, Shipping Policy, Refund Policy, and any order-specific terms shown at checkout form the agreement between you and Beadrift regarding the Services and purchases.
